    On motion of Senator Boley, the Journal was approved and the further reading thereof dispensed with.

    A message from The Clerk of the House of Delegates announced the passage by that body, without amendment, to take effect July 1, 2012, and requested the concurrence of the Senate in the changed effective date, of

    Eng. Com. Sub. for Com. Sub. for Senate Bill No. 564, Creating Aviation Fund and Fleet Management Office Fund.

    On motion of Senator Unger, the message on the bill was taken up for immediate consideration.

    On further motion of Senator Unger, the Senate concurred in the changed effective date of the bill, that being to take effect July 1, 2012, instead of ninety days from passage.

    Senator Unger moved that the bill take effect July 1, 2012.

Sub. for House Bill No. 2046--A Bill to amend and reenact §11-15-9i of the Code of West Virginia, 1931, as amended; and to amend said code by adding thereto a new section, designated §17A-3-4a, all relating to special equipment installed in a motor vehicle for the use of a person with physical disabilities; excluding the equipment from the sales and use tax; and excluding the value of equipment when determining the value of the vehicle for imposition of the tax on the privilege of effecting the certification of the title of the vehicle.

Sub. for House Bill No. 4307--A Bill to amend and reenact §48-27-502 and §48-27-1101 of the Code of West Virginia, 1931, as amended, all relating to domestic violence generally; clarifying that the practice and procedure for domestic violence civil proceedings are governed by court rule; providing that a prohibition against possessing firearms and ammunition is a mandatory provision for domestic violence protective orders; and, providing that a domestic violence protective order state that possession of firearms and ammunition while subject to domestic violence protective order is a criminal violation of state and federal law.

Sub. for House Bill No. 4459--A Bill to amend and reenact §15-12-2, §15-12-5 and §15-12-8 of the Code of West Virginia, 1931, as amended; and to amend and reenact §49-5-13b of said code, all relating to authorizing a court to require a convicted juvenile sex offender whose underlying offense constitutes a first or second degree sexual assault and who is sixteen years of age or older to register as a sex offender; and maintaining confidentiality of juvenile sex offender registration information except for disclosure to law enforcement, school administration and counsel until the juvenile attains the age of eighteen years.

    Whereas, James A. Bowers, Sr. was a boy scout leader and a member of the United Mine Workers of America; and

    Further Resolved, That the Clerk of the Senate is hereby directed to forward a copy of this resolution to the Commissioner of the Division of Highways and James A. Bowers’ daughter, Connie Bowers Chambers, and her husband, Jack Chambers.

    Senators D. Facemire, Unger, Kessler (Mr. Preident), Prezioso, Klempa, Foster, Stollings and Jenkins offered the following resolution:

    Senate Resolution No. 47--Designating March 1, 2012, as “Crime Victims Day at the Legislature”.

    Whereas, The West Virginia Crime Victims Compensation Fund is celebrating “Crime Victims Day at the Legislature” by providing all of the crime victim agencies and individuals who serve victims of crime an opportunity to educate the members of the Legislature and the public about the many services available to assist victims of crime and their families throughout our State; and

    Whereas, The many agencies and individuals serving victims of crime and their families in West Virginia strive to foster the healing of victims and their families through treatment for their many needs including, but not limited to, advocacy for and on behalf of victims and their families, medical treatment and mental health counseling, compensation and restitution; and

    Whereas, The many organizations and individuals who provide assistance to victims of crime and families make valuable contributions to those who have been affected by crime in our State; and

    Whereas, West Virginia is proud of the accomplishments and achievements of the many organizations and individuals who serve the needs of victims of crime and appreciate their many

contributions to our communities; and

    Whereas, There are also many victims or family members present on this special day to foster understanding by the public of the effects of victimization; therefore, be it

    Resolved by the Senate:

    That the Senate hereby designates March 1, 2012, as “Crime Victims Day at the Legislature”; and, be it

    Further Resolved, That the Senate expresses its appreciation to the many organizations which serve victims of crime and their families throughout our state and for the dedication of those individuals who serve these organizations; and, be it

    Further Resolved, That the Clerk is hereby directed to forward a copy of this resolution to the appropriate official with the West Virginia Crime Victims Compensation Fund.

    At the request of Senator D. Facemire, unanimous consent being granted, the resolution was taken up for immediate consideration, reference to a committee dispensed with, and adopted.

    On motion of Senator Unger, the Senate recessed for one minute.

    Upon expiration of the recess, the Senate reconvened and proceeded to the seventh order of business.

    Com. Sub. for Senate Concurrent Resolution No. 51, Requesting DOH name bridge in Man, Logan County, "Cox Joe Gollie Memorial Bridge".

    The question being on the adoption of the resolution, the same was put and prevailed.

    On motion of Senator Unger, the bill was recommitted to the Committee on Education.

    Eng. Com. Sub. for House Bill No. 4037, Relating to the professional and occupational licensure and registration of former and current members of the Armed Forces of the United States.

    On third reading, coming up in regular order, was read a third time and put upon its passage.

    On the passage of the bill, the yeas were: Barnes, Beach, Boley, Browning, Chafin, Edgell, D. Facemire, K. Facemyer, Fanning, Foster, Green, Hall, Helmick, Jenkins, Kirkendoll, Klempa, Laird, McCabe, Miller, Minard, Nohe, Palumbo, Plymale, Prezioso, Snyder, Stollings, Sypolt, Tucker, Unger, Wells, Williams, Wills, Yost and Kessler (Mr. President)--34.

    The nays were: None.

    Absent: None.

    Eng. House Bill No. 4583, Changing certain deadlines associated with the termination, resignation and transfer of school personnel.

    On third reading, coming up in regular order, was read a third time and put upon its passage.

    On the passage of the bill, the yeas were: Barnes, Beach, Boley, Browning, Chafin, Edgell, D. Facemire, K. Facemyer, Fanning, Foster, Green, Hall, Helmick, Jenkins, Kirkendoll, Klempa, Laird, McCabe, Miller, Minard, Nohe, Palumbo, Plymale, Prezioso, Snyder, Stollings, Sypolt, Tucker, Unger, Wells, Williams, Wills, Yost and Kessler (Mr. President)--34.

    The nays were: None.

    Absent: None.

    So, a majority of all the members present and voting having voted in the affirmative, the President declared the bill (Eng. H. B. No. 4583) passed.

    On motion of Senator Plymale, the following amendment to the title of the bill was reported by the Clerk and adopted:

    Eng. House Bill No. 4583--A Bill to amend and reenact §18A-2-2, §18A-2-6, §18A-2-7 and §18A-2-8a of the Code of West Virginia, 1931, as amended; and to amend and reenact §18A-4-7a of said code, all relating to school personnel; changing certain deadlines pertaining to termination of a continuing contract, resignation, retirement, transfer and rehiring of probationary employees; changing the number of days prior to the beginning of the instructional term for limiting the transfer of certain employees; and restricting application of certain provisions pertaining to limiting the transfer of certain employees.

    Senator Unger moved that the bill take effect from passage.

    On this question, the yeas were: Barnes, Beach, Boley, Browning, Chafin, Edgell, D. Facemire, K. Facemyer, Fanning, Foster, Green, Hall, Helmick, Jenkins, Kirkendoll, Klempa, Laird, McCabe, Miller, Minard, Nohe, Palumbo, Plymale, Prezioso, Snyder, Stollings, Sypolt, Tucker, Unger, Wells, Williams, Wills, Yost and Kessler (Mr. President)--34.

    The nays were: None.

    Absent: None.

    So, two thirds of all the members elected to the Senate having voted in the affirmative, the President declared the bill (Eng. H. B. No. 4583) takes effect from passage.
